This classs will satisfy the training and certification requirements in place by:
 - Massachusetts Dept of Occupational Safety (DOS), "Lead Safe Renovator-Supervisor"
 and the
 - US EPA RRP "Certified Renovator" rules  (for states other than Mass.).

Massachusetts has taken over enforcement within its borders, and other states are still subject to the similar EPA rules and requirements. These new rules are now in effect nation-wide and cover work performed in residential homes, apartments, child care facilities and schools built pre-1978. If you are performing work in these structures and disturbing more than 6 square feet of lead paint (interior), you are in violation.

Lead Safe Renovation Rules in Massachusetts

Massachusetts Division of Occupational Safety (DOS) has received EPA authorization to administer its own standards for renovation, repair and painting work in target housing and child-occupied facilities, in lieu of the RRP Rule being enforced by the EPA in Massachusetts.  These standards were published in the Massachusetts Register as amendments to DOS’ deleading regulations, 454 CMR 22.00, on July 9, 2010.  Consequently, contractors and other entities that were previously required to comply with the RRP Rule are now required to comply with the corresponding requirements of 454 CMR 22.00. 

Massachusetts is now administering and enforcing the lead law.  All contractors, property management firms, or municipal entities that perform work on pre-1978 properties must register with the state of Massachusetts and use lead-safe practices if they disturb six square feet of interior paint or twenty square feet of exterior paint. The EPA 6/18/2010 memo delaying fines for those firms or contractors who have not become certified does not apply to Massachusetts and Rhode Island. In New York, Vermont, Maine, New Hampshire and Connecticut contractors have until September 30, 2010 to register for an RRP class and/or apply for certification and until December 31, 2010 to complete the required RRP training.

Massachusetts contractors and property management companies who put off their certification and training are now deemed non-compliant under Massachusetts law. These companies are supposed to delay working on pre-1978 properties until they are registered and trained. According to The Department of Occupational Safety (DOS), they will be subject to fines and work stoppages if they are discovered working on pre-1978 properties without the mandated certifications in Massachusetts. Massachusetts contractors and companies that obtained EPA certification and training before July 9, 2010 are grandfathered, but must still register with the state in order to stay in compliance. That form can be found here: Lead-Safe Renovation Contractor Licensing Waiver. If your firm is not certified with the EPA, use this form: Lead-Safe Renovator ContractorAll contractors must implement the lead-safe practices now, even if they have not acquired certification

NAHB Lead Paint Documents

NAHB's legal department has written template language for remodeling firms to use when working in homes affected by the U.S. Environmental Protection Agency regulation entitled "Lead: Renovation, Repair and Painting." Target homes are defined as pre-1978 homes where renovation activities will disturb lead paint. Please note that these sample documents, notices, and contract language have all been provided for information purposes only, and do not constitute a legal opinion. Care should be taken when drafting such provisions, and it is recommended that an experienced local attorney be consulted for that purpose.
 
If a remodeler expects that a job begun after April 22, 2010 will not be complete, it is recommended that the remodeler use contract language applying to the active regulation. In essence, contracts signed before April 22, should anticipate the lead rule going into effect. However, it is also recommended that a local attorney be consulted in these cases.
